JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Buxar (Ind.) P.S. Case no. 153 of 2016, registered under Sections 290, 272 and 273 of the Indian Penal Code and Section 53(A), 53(B) of Bihar Excise Amendment Act, 2016.

The accusation is of recovery of 30 bottles, each containing 180 ML India Made Foreign Liquor to the Arhar crop, which is shown in the semi constructed house of the petitioner. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case. Further submission is that petitioner used to reside at Chandigarh for his livelihood, but with ulterior motive, he has falsely been implicated in this case. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case,

No.2111 of 2017 (2) dt.31-01-2017 2/2 let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Buxar (Ind.) P.S. Case No. 153 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
