The petitioner is in custody in connection with Samastipur Town P.S. Case No. 305 of 2018 for the offence under Section 414 of the Indian Penal Code and Section 25 (1B)(a)/26/35 of the Arms Act Section 414 of the I.P.C.. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that allegation against this petitioner is that on search one country made pistol loaded with five cartridges were recovered from the possession of the petitioner. He submits that petitioner is in custody since 14.12.2018.

Considering the fact that the petitioner has no criminal antecedent and he has remained in custody nearly three months,

Patna High Court CR. MISC. No.19707 of 2019(2) dt.01-04-2019 2/2 the Court is inclined to enlarge the petitioner on bail. Let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur, in connection with Samastipur Town P.S. Case No. 305 of 2018.
