Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 504, 506, 307, 379, 34 of the Indian Penal Code. The prosecution case is that some altercation took place between the petitioner and the informant. Subsequently petitioner and others came variously armed when this petitioner assaulted with Chilohi, a sharp cutting weapon to the son of the informant Satendra Kumar on his hand, coaccused Ramesh Nat assaulted with iron rod on the head of Satendra Kumar and co-accused Arnun Nat assaulted with brick to the informant and snatched Tabeej of the informant. It is also alleged against co-accused Manju Devi and Fulwa Devi to have pelted stones and snatched jewellery of the wife of the informant.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.37325 of 2015 (2) dt.16-09-2015 2/2 petitioner that petitioner alleged to have caused injury on the hand of Satendra Kumar which has been found to be simple while other injury caused to Satendra Kumar by Ramesh Nat on the head has been found to be grievous. There is counter version of the occurrence.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. It is submitted by learned counsel for the informant that accusation of assault is specific against the petitioner and one of the injuries of Satendra Kumar who was assaulted by the petitioner and Ramesh Nat has been found to be grievous.
Considering the fact that the injury, alleged to have been caused by the petitioner, has been found to be simple and there is counter version of the occurrence also, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 129 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
