The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 302, 34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that Pintu Paswan shot his father, who died and the petitioner, who was accompanying Pintu Paswan fired at him, but missed. The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that it was Pintu Paswan, who fired killing the father of the informant and as far as this petitioner is alleged, against him
Patna High Court CR. MISC. No.20192 of 2022(3) dt.15-11-2022 2/2 allegation is of firing, but then, no one was injured. Learned A.P.P. opposes the bail application and submits that the petitioner was accompanying Pintu Paswan and thus, was a party to the occurrence and he also fired though he missed. It is next submitted that petitioner also has antecedent of one case.
Considering the submissions made by the learned Additional Public Prosecutor, the Court is not inclined to extend the privilege of anticipatory bail application. Accordingly, his prayer for anticipatory bail stands rejected.
