JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-07-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Chausa P.S. Case No. 48 of 2016, registered under Section 147, 148, 149, 341, 323, 307, 354, 379, 504 and 506 of the Indian Penal Code.

The accusation is that ten persons named in the F.I.R., including the petitioners, came at the land of the informant and started fixing Khutta for construction of house. When informant and his brother Rajesh Mandal made protest then both were assaulted by them. When wife of Rajesh Mandal,

Patna High Court Cr.Misc. No.29116 of 2016 (2) dt.20-07-2016 2/2 namely, Babita Devi came to save him then she was also sustained injury. In course of occurrence Pappu Kumar Mandal, Manoj Mandal, Labo Mandal and Lalo Mandal snatched the golden chain from the neck of Babita Devi.

Learned counsel for the petitioners submits that there is general and omnibus allegation against the petitioners and others. Further submission is that the injuries found on the person of the informant and Babita Devi were swelling with tenderness and lacerated wound was found on the head of Rajesh Mandal, brother of the informant. Further submission is that petitioners having no criminal antecedent are in custody since09.05.2016.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chousa P.S. Case No. 48 of 2016.
