====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 25-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Majorganj P.S. Case No. 248 of 2021 lodged under Sections 302, 120B/34 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner submits that in prosecution story there is specific allegation against 4 named accused persons in which name of petitioner has not been figured. He submits that petitioner is not named in the F.I.R., his name has figured in this case by virtue of the confessional statement, nothing incriminating has been discovered from his possession. He further submits that from the F.I.R. itself the cause of this occurrence has been transpired and it is basically a
Patna High Court CR. MISC. No.20313 of 2022(2) dt.25-07-2022 2/2 family dispute but under suspicion the name of the petitioner has figured in this case. He further submits that petitioner is in custody since 21.12.2021, charge sheet has already been submitted and petitioner having clean antecedent. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 248 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
