JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323,341,409,406 and 420/34 of the Indian Penal Code.
It is alleged that the informant's handicapped pension amount of Rs.6300/- was withdrawn by forging signature by Saroj Devi, who is a Ward Member of Redi Panchayat when the petitioner was in connivance with Saroj Devi. When the informant came to know about the forgery being done then she demanded the pension amount whereafter he was abused and pushed away. It is submitted by the learned counsel for the petitioner that the thrust of accusation is against co accused Saroj Devi who
Patna High Court Cr.Misc. No.37634 of 2015 (2) dt.18-09-2015 2/2 has been granted regular bail by the learned court below and the petitioner does not hold any post in the Panchayat. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Hilsa, Nalanda in connection with Hilsa P.S. Case No.601 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
