The petitioners seek bail in Hathauri P.S. Case No.130 of 2018 registered under Sections 414 and 34 of the Indian Penal Code.

The informant alleged that the petitioner and other accused persons were found pooling a pickup van but after seeing the police they started fleeing away. On chase, the petitioners were apprehended and on the pickup van, one theft pumping set was recovered.

The learned counsel for the petitioners submits that petitioners were not arrested on the spot and nothing has been recovered from the possession of the petitioners. The police

Patna High Court Cr.Misc. No.61568 of 2018 (2) dt.06-10-2018 falsely implicated the petitioners on mere suspicion. Petitioners are in jail since 08.07.2018 and petitioners have got no criminal antecedent.

Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that the petitioners have already remained in jail for about three months, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-cum-Sub Judge 10th, Muzaffarpur in connection with Hathauri P.S. Case No.130 of 2018. (Prabhat Kumar Jha, J) Saurabh/- U T
