Petitioner seeks bail in a case registered for the offences punishable under Section 366(A) of the Indian Penal Code.

The present occurrence is said to have taken place in the noon of 06.06.2016 in a market in presence of the informant but informant gave written report to Officer-in-Charge of Ramgarh police station on 07.06.2016, particularly in the circumstance when the concerned police station was situated at the distance of 500 meter from the place of occurrence. The victim girl was recovered at Banaras and

Patna High Court Cr.Misc. No.31256 of 2016 (2) dt.11-08-2016 2/2 petitioner was also caught with her by the U.P. police. Petitioner and victim are co-villagers. The statement of victim was recorded under Section 164 of the Cr.P.C. in which she does not disclose the name of the petitioner rather she stated that she was kidnapped and made captive at Banaras by one unknown person. The medical board found the victim between 18-19 years. Therefore, the aforesaid fact reflects that there was some sweet relation between victim and petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhabhua in connection with Ramgarh P.S. Case No. 113 of 2016.
