JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471/406 of the Indian Penal Code.

The prosecution case is that in the house of Mantoon Mahto one customer service centre of State Bank of India was opened when the accused persons collected Rs.3,30,500/- but failed to deposit the same in the Bank and thereby misappropriated the entire money.

It is submitted by learned counsel for the petitioner that petitioner was employee of collection centre and the thrust of accusation is against co-accused Chandan Kumar Sahni @ Abhinaw Sahni, who was granted regular bail on undertaking to deposit the entire amount of Rs. Rs.3,30,500/- and on condition to

No.37158 of 2015 (2) dt.14-09-2015 2/2 deposit Rs.50,000/- as first installment within a month which gets reflected from the order dated 23.06.2015 passed in Criminal Miscellaneous No. 17020 of 2015, annexed as annexure-2 to the petition. Consequently, co-accused Chandan Kumar Sahni @ Abhinaw Sahni has deposited the entire amount which also gets reflected from the impugned order. The accusation is not specific against the petitioner and petitioner is an unmarried girl.

considering the fact that co-accused Chandan Kumar Sahni @ Abhinaw Sahni undertook to deposit the entire misappropriated amount and petitioner is an unmarried girl, let she be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Rosera, Samastipur in connection with Hasanpur P.S. Case No.169 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
