Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Complaint Case No. 620 of 2002 for the offences instituted under Sections 420, 467 and 406 of the Indian Penal Code. The allegation against the petitioner is that he along with other co-accused got the sale deed of the informant executed in their favour through forged sale deed by deceiving the informant.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.8282 of 2017 (3) dt.03-03-2017 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner has caused no wrongful gain or loss to any person. He is simply a witness to the sale deed in question. The other coaccused has been granted anticipatory bail vide Annexure-4 to the present application.

On behalf of the State, it has been submitted that the petitioner is named in the Complaint case.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 620 of 2002, Tr. No. 488 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sudhir Kumar Sinha, Sub-Judge-1, Jehanabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
