The petitioner seeks bail in Uphara P.S. case No. 39 of 2006 registered under Section 323, 307, 504/34 and some other Sections of the Indian Penal Code and under Section 17 of C.L.A. Act.

The FIR is lodged against unknown. The informant alleged that while he was at his shop, 15-20 unknown persons came and assaulted the informant and others present in the market. The accused persons were members of banned organization. The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner figured in the case during the course of investigation. The petitioner was no information as no summon or warrant of arrest was executed

Patna High Court Cr.Misc. No.61373 of 2018 (2) dt.06-10-2018 2/2 against him. The petitioner was sent to jail in the year 2007 in another case but he was not remanded in this case. The petitioner surrendered in the court on 13.07.2018 and since then he is in jail. Similarly situated accused Bihad Yadav has already been granted bail vide order passed in Cr. Misc. 12953 of 2018. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Swarn Prabhat, learned Judicial Magistrate, 1st class, Daudnagar, Aurangabad in connection with Trial No. 1510 of 2018, arising out of Uphara P.S. case No. 39 of 2006.
