JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-05-2017 The petitioner is apprehending his arrest in connection with Agamkuan P.S. Case No. 445 of 2014, registered for offences punishable under Sections 147, 148, 149, 326, 307 Indian Penal Code and Section 27 of Arms Act.

It has been submitted on behalf of the petitioner that petitioner has not been named in the F.I.R. later on his name surfaced in this case during course of investigation and that too only on the basis of suspicion and save and except suspicion, there is nothing against the petitioner so as to connect him with the present case.

Learned counsel for State could not controvert the above facts.

Having heard both sides, considering the facts and

No.16405 of 2017 (3) dt.03-05-2017 2/2 circumstances of the case, nature of offence and also that petitioner's name transpired in this case only on the basis of suspicion, as such, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Patna City, in connection with Agamkuan P.S. Case No. 445 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Vinod Kumar Sinha, J) sunil/- U
