Petitioner seeks bail in connection with Andhramath P.S. Case No. 99 of 2018 registered for the offence punishable under sections 341, 323, 324, 307, 447 and 504/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to land dispute. As a matter of fact no occurrence in the manner alleged has ever taken place. The allegation under section 307 of the IPC is not made out against this petitioner and injury report does not supports the allegations levelled in the F.I.R. Petitioner is in custody since 03.08.2018. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is direct allegation of
Patna High Court Cr.Misc. No.60963 of 2018(2) dt.06-10-2018 2/2 assault against this petitioner causing injury on the vital parts of the body. Petitioner has long criminal history. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court is not inclined to grant bail to the petitioner.
