JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks bail in connection with Noorsarai P.S. Case No. 120 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner, who happens to be Gotni of the informant, is that the the petitioner had a quarrel with the informant and her husband with respect to sale of a land and it is alleged that due to that husband of the petitioner has taken six years old son of the informant and later on his dead body was found.

Submission of learned counsel for the petitioner is that even according to FIR it is the husband of the petitioner who has taken the son of the informant and petitioner is a lady and is in custody for six months and charge sheet has been submitted in this case.

In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Noorsarai P.S.Case No. 120 of 2016, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
