The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 448, 504, 307, 379, 506/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that the accused persons came variously armed started abusing the informant when the wife of the informant came to rescue then co-accused Pankaj Yadav assaulted the wife and daughter-in-law of the informant on head and hand by 'lathi'. It is further alleged that co-accused Nitish Yadav and Kumod Yadav dragged the daughter-in-law of the informant and snatched gold chain from her neck. It is also alleged that the accused persons resorted to fire in the air.

No.37735 of 2015 (2) dt.18-09-2015 2/2 It is submitted by learned counsel for the petitioner that petitioner is agnate of the informant and specific overt-act has not been alleged. Moreover, corresponding injury has been found and there is counter version of the occurrence also. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Gogari P.S. Case No.138 of 2015, pending before the learned Judicial Magistrate, 1st Class, Khagaria. With the above observation, this application is, accordingly, disposed off.
