JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The present case was lodged by wife of the deceased against four F.I.R. named accused but in course of investigation, on the basis of call details of wife of the deceased as well as petitioner it came to light that petitioner had sweet relation with wife of the deceased and having entered into conspiracy petitioner as well as wife of the deceased with the help of one other person got eliminated the deceased. In course of investigation, the
Patna High Court Cr.Misc. No.34225 of 2016 (2) dt.20-08-2016 2/2 confessional statements of petitioner and wife of the deceased were recorded and furthermore, it was detected that location of mobile phone of the petitioner was found near the place of occurrence. However, except the aforesaid circumstances, there appears to be nothing against the petitioner, against whom the investigation has already been completed.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Chiraiya P.S. Case No. 211 of 2015.
