The petitioner is apprehending arrest in a case registered for the offences punishable under section 47(a) of the Excise Act.

110 liters of country made illicit liquor were recovered from a hutment adjacent to the house of the petitioner. It is submitted by the learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.37691 of 2015 (2) dt.18-09-2015 2/2 consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Excise Case No. 37 of 2011 pending in the court of learned CJM, Aurangabad. This application is disposed of with the aforesaid observation/direction.
