JUSTICE SANJAY PRIYA ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Aurangabad (Muffasil) P.S. Case No. 99 of 2016 instituted for the offence under section 379 of the Indian Penal Code. It is alleged that there is no recovery from the possession of this petitioner. His name has come in the confessional statement of co-accused during investigation. It is alleged in the written report that three persons came on motorcycle and snatched Rs. 1405/- from the possession of the informant.

The learned Sessions Judge has mentined in the impugned order that name of the petitioner has come in the confessional statement of co-accused, Sandeep Kumar in para-14 of the case diary.

Patna High Court Cr.Misc. No.10066 of 2017 (2) dt.09-03-2017 2/2 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Aurangabad (Muffasil) P.S. Case No. 99 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438(2) Cr.P.C.
