JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-07-2017 Supplementary affidavit has been filed on behalf of the petitioner. Let it be kept on the record. Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Begusarai Town P.S. Case No. 515 of 2014 for the offences punishable under sections 341, 323, 305, 307, 379, 506 and 34 of the I.P.C. Allegedly, the petitioner and two other co-accused started assaulting the informant. The petitioner assaulted with lathi on his left leg causing fracture and the co-accused Gautam Sah assaulted with Danda in his left hand causing fracture, co-accused Santosh Sah assaulted with rod on his head causing head rapture.

Patna High Court Cr.Misc. No.19091 of 2017 (4) dt.14-07-2017 2/2 Submission is of false implication and that the injury report of the informant has been annexed with the supplementary affidavit as Annexure-2 from which it reveals that all the three injuries found on the person of the informant are simple caused by hard and blunt substance, no fracture was found and as such the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that simple injury has been found.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Begusarai in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
