====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 31-10-2018 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in connection with Riga P.S. Case No. 89 of 2017 registered for the offence punishable under sections 363 and 366(A)/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case due to village politics. It is evident from Annexure-2 that merely on wrong information informant has lodged the present case against this petitioner and he does not want to proceed further in the matter. As a matter of fact, her daughter herself had gone with the petitioner and solemnised marriage with him as is evident from Annexure-3. Moreover, one co-accused has been granted bail by a Co-ordinate Bench of this Court vide order

Patna High Court Cr.Misc. No.59797 of 2018(2) dt.31-10-2018 2/2 dated 22.08.2017 passed in Cr. Misc. No. 39983 of 2017. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Sitamarhi in connection with Riga P.S. Case No. 89 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
