JUSTICE BIRENDRA KUMAR ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304-B and 201/34 of the Indian Penal Code.

After two months of death for dowry a complaint case was filed which was sent to the police for registration of a case and accordingly, Kudra P.S. Case No.225 of 2014 was registered. However, after investigation, police did not sent up any of the accused for trial. Thereafter, on protest petition, the court below is proceeding and the protest petition has been registered as Complaint Case No.1274 of 2015.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.13783 of 2017 (2) dt.30-03-2017 above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua/Successor Court in connection with Complaint Case No.1274 of 2015, Reg. No.1446 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
