In this case, the petitioner is seeking regular bail in connection with Madhepura P.S. Case No. 649 of 2014 registered for the offence under Section 392 of the Indian Penal Code.

The allegation has been made that the informant along with Chhotu Kumar proceeded for Village- Piprahi by his motor-cycle in the night at 9.30 P.M. Three unknown criminals riding on a Hero Honda Motor-cycle stopped the informant, one criminal on the point of country made fire arms took away the key of the Black Colour Pulsar motor-cycle of the informant, got down the informant and his companion from the said

No.32732 of 2016 (2) dt.22-08-2016 2/2 motor-cycle and one criminal fled away towards Saharsa after taking away the motor-cycle and another criminal took away the mobiles of the informant and fled away towards Saharsa by sitting on the motor-cycle of the informant. One Black Colour Pulsar motor-cycle, used in crime one mobile and cash of Rs. 4500/- has been recovered from the house and possession of the petitioner.

In such view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

The court below is directed to complete the trial within nine months. If the trial is not completed within the said period, the petitioner will be at liberty to renew his prayer for bail.
