JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Delha P.S. Case No. 176 of 2018 instituted for the offence under Sections 341, 323, 379 and 384/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has no criminal antecedent. He is in custody since 24.07.2018. His name has been taken by nearby people.

In the written report mere suspicion has been raised against the petitioner. There is no recovery of any incriminating article from possession of the petitioner. No Test Identification Parade has been held.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.59861 of 2018 (2) dt.06-10-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Gaya, in connection with Delha P.S. Case No. 176 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
