This application is for grant of regular bail in connection with Panapur P.S.Case No.67 of 2014 for the offences under Sections 457 and 380 of the Indian Penal Code. Allegation against the petitioner is that as per FIR is of commission of theft of Rs.3,17,000/- and ornaments from the house of the informant. The petitioner is not named in the FIR. Submission of the learned counsel for the petitioner is that he has been made accused only on the basis of confessional statement and nothing has been recovered from his possession though he is accused in one more case but he is on bail in that case and now the petitioner is in custody for about two months. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.60627 of 2018 (2) dt.06-10-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however once he completes three months in custody, the learned court below shall release him on bail in connection with Panapur P.S.Case No.67/14 to his own satisfaction.
With the aforesaid observation, this application is disposed of.
