JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 328/34 of the Indian Penal Code. Prosecution case is that sister of the informant, namely, Rani Kumari, got married with Deepak Tiwary, who had illicit relation with another girl. On being opposed by Rani Kumari, Deepak Tiwary used to torture her. On 19.5.2016 informant was informed that his sister was hospitalized. He rushed there and her sister died in course of treatment.

It has been submitted on behalf of the petitioner that he is in custody since 20.5.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is father-in-law of the deceased. He is separate in mess and property from the husband of the deceased. Informant has filed a petition in the court below stating due to mistake of fact the present case has been instituted, same is Annexure-3 to the present application.

On behalf of the State, it is submitted that petitioner is

Patna High Court Cr.Misc. No.32295 of 2016 (3) dt.16-09-2016 2/2 named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Ara Nawada P.S. Case no. 375 of 2016.
