The petitioner apprehends his arrest in connection with Begusarai Muffasil P.S. Case No. 104 of 2016, registered for the offences punishable under Sections 406, 420, 467, 468, 471/34of the Indian Penal Code.
Allegedly, the petitioner and other co-accused being in conspiracy took Rs. 10,04000/- from the informant to take his daughter admitted in M.B.B.S. course, but admission was not done and only Rs. 01, 85,000/- was returned and further cheque of Rs. 3, 50,000/- and 3,25,000/- which were given were bounced. Submission is of false implication and that the matter has already been settled and the amount has already been
Patna High Court Cr.Misc. No.3745 of 2017 (2) dt.14-02-2017 2/2 returned to the informant and now the informant does not have any grievance against the petitioner. On that basis Vikash Kumar Verma has already been allowed pre-arrest bail vide Cr. Misc. No. 31002 of 2016 by order dated 09.11.2016 by another co-ordinate Bench of this court and the case of the petitioner is on better footing.
The learned A.P.P. does not oppose the prayer of prearrest bail under the changed circumstances. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Muffasil P.S. Case No. 104 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
