JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 395 of the Indian Penal Code.

The prosecution case is that on the alleged date of occurrence dated 12.01.2015, the informant Chandan Kumar along with his villager Raja Kumar were going to Raniganj riding motorcycle bearing no. BR-11P-5521 and when they were passing Orahi Lokahi, six miscreants riding their motor cycles intercepted the informant and snatched away the motorcycle of the informant giving threat with dire consequence in case they raised any alarm. It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.02.2016. Charge sheet has been submitted in the present case. There is no allegation of tampering

Patna High Court Cr.Misc. No.31994 of 2016 (3) dt.21-09-2016 2/2 with the witnesses alleged against the petitioner. The petitioner is not named in the FIR. The petitioner has not been put on T.I.parade. There is no recovery of any looted article from the possession of the petitioner. The name of the petitioner has come after five months by the co- villager of the informant, who has stated that he had seen the petitioner in the vicinity where the occurrence is said to have taken place.

On behalf of the State it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri NiteshKumar, learned Judicial Magistrate,1st Class,Purnea in connection with Barhara P.S.Case No. 11 of 2015.
