The petitioner, who is in custody, seeks bail in connection with Parwalpur P.S. Case No. 68 of 2018 registered for the offence punishable under Sections 341, 323, 307, 379, 504 read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against petitioner is of abusing informant to remove building materials and fodder cutting machine kept outside the gate and fired upon petitioner which missed him but injury was caused at 3 places of body by gun powder.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.60237 of 2018(2) dt.11-10-2018 2/2 that petitioner and informant are agnates and due to previous land dispute pending between the parties, the petitioner has been falsely implicated in this case. It has been further submitted that informant was carrying a country made pistol in his hand, and in a fit of rage he fired the country made pistol aimed at the petitioner but the said pistol itself exploded in his hand and as such he sustained injuries on his hand and neck etc. Injuries are reported to be simple in nature. Petitioner has no criminal antecedent and he is in custody since 24.07.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, in connection with Parwalpur P.S. Case No. 68 of 2018. (S. Kumar, J) veena/- U T
