Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application. It is second attempt made on behalf of the petitioner for grant of regular bail. A report was called for from the trial Court regarding the stage of the case. It has been reported that 11 prosecution witnesses have already been examined in the case and the trial is expected to be conclude within a period of two months. The petitioner is in custody since 20.11.2008.
On behalf of the state it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, I am
Patna High Court Cr.Misc. No.30683 of 2016 (3) dt.08-09-2016 2/2 not inclined to grant bail to the petitioner. The same is rejected in S.Tr. No. 51 of 2010, arising out of Runnisaidpur P.S. Case No. 315 of 2008, pending in the court of learned Additional Sessions Judge-1st, Sitamarhi.
However, the trial court is directed to conclude the trial within a period of two months from the date of receipt/production of this order.
The District Magistrate and the Superintendent of Police, Sitamarhi are also directed to produce the remaining prosecution witnesses on the date fixed by the trial court, so that the trial could be concluded within the stipulated period. Let a copy of this order be communicated to the District Magistrate and the Superintendent of Police, Sitamarhi. (Sudhir Singh, J.) Amit/- U T
