JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47 of Bihar Excise Act. The recovery of fifty litres country made liquor was made from a field and petitioner as well as two others were arrested while they were trying to flee from there. Admittedly, nothing has been recovered from conscious possession of the petitioner, who is languishing in jail custody since 26.04.2016 without having any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.36245 of 2016 (2) dt.24-08-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sikrahna at Dhaka, Motihari in connection with Chiraiya P.S.
