The petitioner apprehends his arrest in connection with Vaishali Complaint Case No. 1359 of 2019, Trial No. 3107 of 2019 registered for the offences punishable under Sections 494, 498(A) of the Indian Penal Code & 4 D.P. Act.

The petitioner is the husband of Shobhavati Devi who filed a complaint alleging therein that her marriage was solemnized with the petitioner and customary presents were given on the occasion of the marriage. It is further alleged that the petitioner Ratnesh Paswan has solemnized his second marriage with another girl on 16.7.2013 and he tried to kill the complainant by pouring kerosene oil on her person.

Patna High Court CR. MISC. No.17752 of 2020(7) dt.27-10-2021 2/2 Order dated 19.3.2021 of the learned coordinate Bench shows that the petitioner was ready to pay Rs. 3,000/- per month to the victim by way of interim maintenance subject to any order which may be passed by the court below.

Learned counsel for the petitioner has submitted that the petitioner is still ready to pay the stipulated amount subject to any order which may be passed by the learned court below. The petitioner is directed to adhere with his words and pay the dues of maintenance from 19.3.2021 to the O.P. No. 2 and further Rs. 3,000/- per month must also be paid to the victim. The court below may at liberty to consider other facts submitted by the parties from time to time.

With these observations, the anticipatory bail is allowed and let the petitioner in the event of his arrest or surrender within four weeks before the learned court below be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Vaishali at Hajipur in connection with Vaishali Complaint Case No. 1359 of 2019, Trial No. 3107 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
