Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-325, 307, 379/34 & other minor sections of the Indian Penal Code.
There is allegation against the petitioner that he assaulted the informant by means of iron rod, causing injury on his head and, thereafter, he as well as other accused assaulted the other injured of this case. The informant, Dharmendra Kumar Singh appears to have sustained altogether two injuries, i.e. one
Patna High Court Cr.Misc. No.33903 of 2016 (2) dt.19-08-2016 2/2 injury on his head whereas; another injury on his right hand. The injury, found on right hand of the injured, Dharmendra Kr. Singh appears to be grievous in nature.
Submission on behalf of petitioner is that there is case and counter case between the parties and persons, from both the sides, sustained injury. Moreover, the alleged occurrence took place on account of dispute of the passage and even if, the accusation assumed to be true, then also, at best Section-325 of the Indian Penal Code is attributed against the petitioner. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jamui P.S. Case No. 183 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Jamui. (Hemant Kumar Srivastava, J) A.K.V./- U T
