This application, for grant of anticipatory bail, arises out of Hajipur Town Police Station Case No. 316 of 2017, disclosing offences under Sections 147, 148, 149, 342, 186, 332, 333, 353, 307, 427, 504 and 436 of the Indian Penal Code. Learned Counsel appearing on behalf of the petitioner is correct in his submission that in identical circumstance, other co-accused persons, namely, Rakesh Rai and Haresh Rai, have been granted anticipatory bail by this Court by order, dated 14.02.2019, passed in Criminal Misc. No. 63399 of 2018. Considering the above, this application is allowed. Let the petitioner, Jhamu Rai @ Sonu Kumar, in the

No.23444 of 2019(2) dt.11-04-2019 2/2 event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, at Hajipur, in connection with Hajipur Town Police Station Case No. 316 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
