JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 406 of the I.P.C.

The prosecution story, in brief, is that the informant's truck bearing registration No.WB-23A/4046 loaded with clothes etc proceeded from Varanasi to Calcutta. Said truck was driving by driver Jai Narayan Sah but the truck did not reach Calcutta. When the informant enquired into the matter, the said truck was shown in Sasaram, after that it was traceless. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.4.2016 and the charge sheet has been submitted in the present case. The petitioner has got no

Patna High Court Cr.Misc. No.30547 of 2016 (4) dt.08-09-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. In course of investigation suspicion has been raised against the petitioner.

On behalf of the State, it is submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram in connection with Sasaram (T) P.S. case No.31 of 2006.
