JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 25[(1) (a)], (1-B) (a) (C), 26, 29, 35 of the Arms Act. Semi finished 10 pistols, barrels of pistols, magazines and other apparatus, which are used to prepare fire arms, are said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 9.9.2015. Submission on behalf of the petitioner is that on the same day, Sabour (Goradih) P.S. Case No.176 of 2015 was lodged against the petitioner for recovery of same articles and moreover, the seized semi finished pistols were not effective. Considering the aforesaid facts and circumstances as

No.30551 of 2016 (3) dt.17-08-2016 2/2 well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 9.9.2015 and prior to institution of the case, petitioner had not been made accused in any other case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 5th Additional Sessions Judge, Bhagalpur in connection with S.T. No.34 of 2016 arising out of Mojahidpur P.S. Case No.172 of 2015.
