JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Dulhin Bazar P.S. Case No. 107 of 2016, registered for the offences punishable under Sections 328, 302, 201 of the Indian Penal Code.

It is submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner that he along with the other co-accused persons administered poison to the deceased, but no specific allegation has been made against the petitioner. The petitioner and others have been falsely implicated in this case only because the informant was demanding more share, co-accused Veena Devi and Ranju Devi have already been

Patna High Court Cr.Misc. No.13586 of 2017 (2) dt.30-03-2017 2/2 allowed bail and further Binda Yadav has already been allowed pre-arrest bail vide Cr. Misc. No. 1430 of 2017 and Cr. Misc. No. 10191 of 2017 by another co-ordinate bench of this court and the case of the petitioner is similarly situated. and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail by another co-ordinate bench of this court.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Danapur (Patna), in connection with Dulhin Bazar P.S. Case No. 107 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
