JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 366(A) of the Indian Penal Code.
Petitioner is not named in the first information report but the victim in her statement recorded under Section 164 of the Cr.P.C. stated that she was taken away at different places by F.I.R. named accused Pramod Mandal as well as Amit. So far as petitioner is concerned, it is only stated that while she was confined at Patna, petitioner and three others had given threatening to kill her and except the aforesaid materials, there appears to be nothing against the petitioner. Moreover, one coaccused Amit Kumar Mandal having more or less similar allegation has already been granted provisional anticipatory bail
Patna High Court Cr.Misc. No.29585 of 2016 (2) dt.26-07-2016 2/2 by a Co-ordinate Bench of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Khagaria in connection with Mansi P.S. Case No.103 of 2015.
