JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Durgawati P.S. Case No. 30/2023, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has no criminal antecedent. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is neither driver nor owner of the car. Petitioner is in custody since 09.02.2023.

Learned APP has vehemently opposed the prayer for bail.

Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge, Excise-II, Kaimur at Bhabhua in connection with Durgawati P.S. Case No. 30/2023.
