The petitioner apprehends arrest in a case under sections 498A, 307 and other allied sections of the Indian Penal Code. Learned counsel for the petitioner submits that he is the husband of the informant and the instant case has been lodged as a counter blast to the earlier case lodged by his father Krishna Deo Pandey giving rise to Mairwa Police station case no. 98 of 2013 dated 24.5.2013. Prior to that his father had also filed a Sanaha on 16.5.2013 and he has also annexed the application written to the police stating that the prosecution side is threatening them. Learned counsel submits that the informant did not sustain injury, as such no case under section 307 IPC would be made out.
Patna High Court Cr.Misc. No.42473 of 2014 (2) dt.10-04-2015 In the facts and circumstances of the case, in the event of arrest/surrender, let the petitioner as mentioned above be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in Kateya Police station Case No. 81 of 2013 with the condition that he would not physically be absent for two consecutive dates at a stretch till charge is framed.
