ANJANA MISHRA ORAL ORDER 15-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 26.10.2018 in connection with S.Tr. No.75 of 2019 arising out of Chhabilapur P.S. Case No.67 of 2018 registered for the offence under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that so far as the present petitioner is concerned, he has been framed only because he is known to other co-accused persons and the allegation is that he along with Sarita Devi and Manish Mistry has conspired to kill the husband of the informant. Diary in the present case was called for, which has since been received.
Learned counsel for the State after perusal of the
Patna High Court CR. MISC. No.22440 of 2019(5) dt.15-10-2019 2/2 case diary submits that save and except the allegation that he has conspired, there is no other cogent material on the record to indicate the complicity of the petitioner. Considering the aforementioned facts and circumstances and that the petitioner has two other antecedents relating to the N.I. Act, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 2nd, Biharsharif, Nalanda, in connection with S.Tr.
