The petitioner is in custody in connection with Kahalgaon (Ghogha) P.S. Case No. 732 of 2018, registered for the offence punishable under Sections 401, 413, 414, 420 of the I.P.C..
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that allegation against this petitioner is that he was involved in theft of motorcycle. Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner, the name of the petitioner surfaced on the confessional statement of co-accused Arbind Kumar, who confessed before the police that he sold the stolen motorcycle to this petitioner. Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than three months, the Court is inclined to grant bail to the petitioner. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S.
