JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One cartridge is said to have been recovered from conscious possession of the petitioner when petitioner, allegedly, along with others had assembled to make preparation for committing dacoity. 18 bottles of Indian made foreign liquor were recovered from the place where petitioner and his associates were found sitting. Petitioner does not have any criminal antecedent and is languishing in jail custody since 03.04.2016. Admittedly, bottles of Indian made foreign liquor have not been recovered from conscious possession of the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two
