JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner is named but general and omnibus allegation of making indiscriminate firing has been levelled against the petitioner and other accused.

It would appear from the record as well as submission of the parties that some co-accused have already been granted privilege of bail and 11 co-accused faced trial in Sessions Trial No. 402 of 2013 and all the 11 co-accused were acquitted by the trial court vide judgment dated 30-03-2015.

Learned counsel for the petitioner points out

Patna High Court Cr.Misc. No.36919 of 2015 (2) dt.01-09-2015 2/2 that the occurrence took place in the year, 2011 but charge sheet against the petitioner was filed after filing of the present application.

Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rajepur P.S. Case No. 67 of 2011 to the satisfaction of Learned Sub Divisional Judicial Magistrate, East Champarana at Motihari.
