JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner is apprehending his arrest in connection with Birpur P.S. Case No. 257 of 2016 registered for the offences punishable under Sections 366 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though the petitioner is named in the F.I.R, but the victim is a married lady and as a matter of fact, there was love affair between the victim girl and the petitioner. The victim girl herself went with him and returned back.

Heard the learned APP also. Learned APP has opposed the prayer of bail, as the victim has supported the

Patna High Court Cr.Misc. No.12603 of 2017 (2) dt.30-03-2017 2/2 prosecution case in her statement recorded under Section 164 of the Code of Criminal Procedure.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Birpur P.S. Case No. 257 of 2016.
