JUSTICE ASHUTOSH KUMAR ORAL ORDER 02/- 14.07.2020 Heard Mr. Ranjeet Kumar Mishra, learned counsel for the petitioner and Mr. Nitya Nand Tiwary, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Belsand P.S. Case No. 118 of 2019 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code. It has been submitted on behalf of the petitioner that though he is alleged to have assaulted the informant by means of butt of a pistol, but the accusation against him is because of village enmity and politics.

However, regard being had to the nature of accusation against the petitioner, I am not inclined to grant anticipatory bail to him. The prayer for grant of anticipatory bail is, accordingly, rejected. If the petitioner surrenders before the Court below and prays for regular bail, the Court below shall look into all the aspects of the matter including the fact that one of the co-accused persons has been granted bail and shall pass orders in accordance with law without being prejudiced by the fact that the present petition has not been entertained by this Court.

The petition stands dismissed.
