The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 376 and 120B/34 of the Indian Penal Code.

It is alleged that Kundan Kumar Sah, brother-in-law of the petitioner (Dewar) established forceful physical relationship with the informant when the petitioner facilitated the commission of the offence.

It is submitted by learned counsel for the petitioner that the informant wanted to marry with Kundan, but since the petitioner did not help her in marrying with Kundan, hence, she has roped the petitioner in the present case. Though, now the informant has married with one Md. Abbas.

No.36014 of 2015 (2) dt.21-08-2015 2/2 Considering the thrust of accusation against Kundan Kumar Sah, let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Katihar in connection with Mansahi P.S. Case No. 45 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
