The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 447, 354, 379 of the Indian Penal Code and 3 / 4 of Witchcraft Practices Prohibition Act, 1999.
The prosecution case is that the accused persons including the petitioner came to the door of the informant and started abusing by calling her a witch. It is alleged that co-accused also tried to outrage the modesty of the informant.
It is submitted that the petitioner is the
Patna High Court Cr.Misc. No.35811 of 2015 (2) dt.04-09-2015 2/2 agnate of the informant and at earlier point of time, the petitioner had lodged Turkaulia P. S. Case No. 319 of 2015 against the informant's son and husband.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia P.S. Case No. 326 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
