JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 147, 148,326,302,120(B)/34 of the Indian Penal Code. It is alleged that the petitioner and other five coaccused opened indiscriminate firing upon Manmohan Singh, the brother of the informant and other co-accused instigating to kill him. It is also alleged that in committing crime there is conspiracy of other co-accused also.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.09.2015. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. No specific injury has been

Patna High Court Cr.Misc. No.32530 of 2016 (3) dt.21-09-2016 2/2 attributed against the petitioner. Other co-accused has been granted bail vide Annexure 2 to the present application. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th A.D.J., Buxar in connection with Buxar P.S.Case No. 356 of 2015.
