JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-08-2015 The present application has been filed for modification of the order dated 02.07.2015 passed in Cr. Misc. No. 26523 of 2015 with regard to deposit of 20% of the alleged due amount.

On submission of learned counsel for the petitioner that petitioner is ready to deposit 20% of the alleged due amount, the petitioner was granted provisional anticipatory bail. The relevant portion of the order reads as follows:- ".................However, it is submitted by learned counsel for the petitioner that the petitioner will deposit 20% of the alleged due amount through bank draft in favour of State Food and Civil Supplies Corporation within ten months"

In view of the fact that on submission of learned counsel for the petitioner, the order was passed, this

Patna High Court Cr.Misc. No.36467 of 2015 (2) dt.26-08-2015 2/2 court is not inclined to entertain the modification application. Accordingly the modification application stands dismissed in connection with Mohania P.S. Case No. 147 of 2015, pending in the Court of learned Chief Judicial Magistrate, Kaimur, Bhabua.
